A newspaper can only publish details of a person
under the age of 18 after appealing to a magistrate
or judge to remove reporting restrictions. This is not
an automatic right. However, the reporting team here
and at Chesham has successfully fought cases to
have section 39 orders removed and cases have
appeared in the newspapers with names on.
Should a youngster break their ASBO new section 39
order would be placed on the new case and would
have to be fought again.
Of course until there is a finding of guilt, any
publication about the details of the case would be
contempt of court and could potentially be
considered defamation.
